There’s cash up for grabs for Americans and they don’t even have to prove they deserve it. The payouts involve the Apple Federal Credit Union and a class action lawsuit that was recently finalized with a settlement. The company serves thousands of customers and it’s this group who may be in line for a one-off payout depending on the fees they were incorrectly charged.
The details about who is eligible and how the payments will be made can be found below.
Americans can claim their share of a $2.5 million settlement
If you were a client of Apple Federal Credit Union between January 7, 2021, and March 31, 2024, you could be eligible for a cash payout. The financial firm has to pay out $2.5 million in a settlement after it was found that some people were wrongly charged overdraft fees. The settlement doesn’t apply to all clients though, only those with overdrafts who were incorrectly charged fees.
The class action suit claims that Apple Federal Credit Union charged fees relating to overdrafts on ATM withdrawals, debit card transactions, and transfers that were supposed to be covered by account arrangements but clients were also charged for.
Visa and Mastercard have also recently settled a class action suit involving incorrect fees, revealing that even the top and most reputable institutions can be caught out in financial wrongdoing or oversights.
What did Apple Federal Credit Union do wrong?
The situation arose when the clients making the transactions had positive account balances at the time, but the transactions were finalized by the bank some time later when these clients’ balances had dropped into the negative.
This led to fees being charged for overdraft facilities when, in fact, the clients were not in the negative at the time of initiating the transaction. Documents relating to the lawsuit describe this situation as “authorized positive but unauthorized negative.”
Apple Federal Credit Union has not admitted any wrongdoing but has accepted that its clients must be refunded or compensated.
How will the settlement payments be distributed and how much will clients be paid?
Luckily for eligible members, they don’t need to do anything to collect their share of the $2.5 million settlement. No one has to submit any documentation or prove in any way that they were charged fees unfairly to collect their money. The financial firm has identified which clients were affected through its internal data-tracking processes, so no one will miss out on what they’re due.
Automatic payments will be made into their accounts and the amount will depend on the fees they incurred during the abovementioned period. Many will receive less than $100 based on their incurred fees, meaning these clients will receive only a proportion of the settlement fund.
The final settlement approval has been set for June 17, 2025. If you want to opt out, the deadline is April 20, 2025.
Is there another settlement eligible Americans can claim in 2025?
If you live in Oakland, California, you may be in line for a significant windfall under another class action lawsuit against the city’s government. This case involves a data breach that happened two years ago in 2023 that saw residents’ personal information stored on the City of Oakland’s system being exposed, including Social Security numbers, driver’s license information, medical records, and more.
The City, which has a population of 440,000, is being sued for not doing enough in terms of cybersecurity to protect a data breach, and now it has to pay. Hundreds of residents are eligible to claim and they could be due $5,000 out of the multimillion-dollar settlement after submitting just one document as proof of eligibility and residents who believe they may have been affected can consult the City of Oakland’s official channels.
No matter how secure the big organizations and companies try to make their cybersecurity, cybercriminals are getting cleverer every day and the process of keeping up with sophisticated online crime is becoming more and more complex. It’s not just financial institutions getting into class action trouble, though. In a different kind of case, Ford was slammed with two suits over the same EcoBoost engine.
