There is nothing like a classic meal to make you feel at home. Many people will agree that the United States is home to many memorable classics. Who can forget the classic hot dog? Other classics include tater tots, fried chicken, apple pie, and many more. However, it’s not every day that you don’t feel at home in your home. A real estate company will be giving payouts to one group of people for that very reason.
The company that made people feel less at home
Between June 11, 2015, and December 3, 2020, some Americans felt less at home due to certain events caused by the real estate company formerly known as Realogy Holdings Corporation (Corp.). Various brands are affiliated with the real estate company, including Better Homes and Gardens Real Estate, Century 21, Coldwell Banker, ERA, and Sotheby’s International Realty.
A class action lawsuit was filed by homeowners Sarah Bumpus of California, Cheryl Rowan of Minnesota, and Micheline Peker of Florida in June 2019, which claimed that agents affiliated with then-Realogy’s Coldwell Banker brand phoned them without consent using a dialer system to have their homes listed as for sale. According to Rowan and Peker, they allegedly also received unwanted prerecorded messages from Realogy agents, all of which violated the Federal Telephone Consumer Protection Act (TCPA).
The TCPA prevents unwanted and unconsented autodialed phone calls to consumers, including those registered on the National Do Not Call Registry. Realogy Holdings Corp. denied all allegations but agreed to a settlement of $20 million to resolve these allegations and avoid going to trial.
Only this group of people will qualify for a payout
We can all agree that it is very annoying and unsettling when you keep receiving unwanted phone calls. Thankfully, one group of people will qualify for a cut of the settlement, but only if they meet these requirements:
- You received more than one telemarketing phone call from a Coldwell Banker-affiliated real estate agent between June 11, 2015, and December 3, 2020
- Your number has been on the National Do Not Call Registry for at least 31 days between June 11, 2015, and December 3, 2020
- These phone calls were made using Mojo, PhoneBurner, or Storm dialer within one year
- You filed a valid claim by the deadline
OR
- You received a phone call from a Coldwell Banker-affiliated real estate agent
- This phone call included a prerecorded or artificial message
- This phone call took place between June 11, 2015, and December 3, 2020
- You filed a valid claim
All class members who were affected by the incident would have received a notice of the Realogy TCPA Settlement.
Just follow these steps to receive your cut
According to the terms of the Realogy TCPA Settlement, all class members will qualify for an equal cut of the total settlement amount. It is extremely important to note that at least 15% of class members must submit a valid claim form to receive a $281 payout. The payout amount will thus vary and is dependent on the total number of filed claims.
If you received a notice of the incident, make sure that you file a valid claim form by the deadline of July 3, 2025. You will have to provide proof of the telephone number(s) that received unwanted calls. If you wanted to be excluded and/or object to the class action settlement, the deadline is also July 3, 2025.
The Realogy TCPA Settlement has a final approval hearing, which has been scheduled for August 28, 2025, in San Francisco, during which the judge will make the call (one which is not unwanted) whether to grant final approval or not. Keep an eye out for other settlements that will serve more than justice. For more information about this settlement, you can visit Top Class Actions and get informed about how to file a claim.
Disclaimer: You should not submit false or inflated claims under penalty of perjury, as class‑action claim forms historically required declarations signed “under penalty of perjury” to ensure authenticity. Submitting a fraudulent claim not only carries legal exposure—including potential civil and criminal sanctions—but also harms other eligible class members by diluting the available settlement pool.
