It’s a week’s worth of celebration! The fourth of July, or Independence Day, is tomorrow, meaning it will be stars and stripes and freshly baked pies all around. Not only that, this data breach settlement could make you up to $7,000 richer! Check the list of requirements first, and then rush to file a valid claim form before the July 7 deadline.
This data breach settlement could make you rich
Navvis & Company partners with health systems, health plans, and physician enterprises to help them with value-based care. The company has a partnership with a health system called SSM Health. SSM Health is a non-profit that serves patients in Illinois, Missouri, Oklahoma, and Wisconsin. Unfortunately, not all systems can operate smoothly all the time.
Navvis & Company experienced a cyberattack between July 12, 2023, and July 25, 2023. The cyberattackers breached the company’s network, accessed personal data, and encrypted files with ransomware. At least 2.8 million people were affected by the data breach, and the exposed and stolen data included:
- Names
- Birth dates
- Social Security numbers
- Beneficiary HIC numbers
- Case identification numbers
- Health plan information
- Health record information
- Medical record numbers
- Diagnosis/clinical information
- Medical treatment/procedure information
- Health insurance information.
A class action lawsuit followed. Plaintiffs argued that the defendants, Navvis & Company and SSM Health, could have implemented proper cybersecurity measures to prevent the breach. The defendants denied any wrongdoing, but agreed to a $6.5 million settlement to resolve all the allegations.
These are the list of requirements to claim
According to The HIPAA Journal, the 2.8 million people who were affected by the data breach included patients and plan members of:
- SSM Health
- Arkansas Health Network
- Horizon Blue Cross Blue Shield of New Jersey
- RWJBH Corporate Services
- Hawai’i Medical Service Association
- Triple-S Management Corporation
- Allina Health
- Florida Medical Clinic.
If other class action lawsuits have taught us one thing, it is that not everyone will be eligible to claim from the class action settlement. You must meet the following list of requirements before you file a claim:
- You were a patient or plan member of the abovementioned list between July 12, 2023, and July 25, 2023
- Your data was compromised in the breach between July 12, 2023, and July 25, 2023
- You received a mailed breach notice letter between September 22, 2023, and June 4, 2024
- You have documented proof of expenses and losses
- You filed a valid claim form by the deadline
Proof of expenses and losses includes documentation like bank statements, credit card statements, and receipts. Eligible class members may claim up to $2,000 for ordinary losses and up to $5,000 for extraordinary losses, for a combined total of up to $7,000.
Make sure you file a valid claim form before the deadline to get up to $7,000
Class members’ claims, attorneys’ fees, class representative awards, and legal costs and expenses will be funded by the $6,500,000 settlement fund, as per the settlement’s terms and conditions. Class members will be able to pocket the following due to the data breach:
Documented ordinary losses
- Bank fees, communications costs, travel fees, and credit monitoring charges
- Claim up to $2,000
Documented extraordinary losses
- Losses due to identity theft and fraud
- Claim up to $5,000
All class members will be eligible for two years of three-bureau credit monitoring services, as well as a pro rata cash payment. The latter will be distributed once all expenses, costs, and claims have been settled. The pro rata amount will rely on the number of valid claims that have been filed.
You must file your valid claim form by the July 7, 2025, deadline. The settlement has a final approval hearing scheduled for July 10, 2025. Keep an eye out for the latest news of other settlements. Disclaimer: You should not submit false or inflated claims under penalty of perjury, as class‑action claim forms historically required declarations signed “under penalty of perjury” to ensure authenticity. Submitting a fraudulent claim not only carries legal exposure—including potential civil and criminal sanctions—but also harms other eligible class members by diluting the available settlement pool.
